These Terms govern your use of EcomGini, a service operated by IT Pal Solutions, Bangladesh. By creating an account or using EcomGini you agree to these Terms on behalf of yourself and the business you represent.
1. The service
EcomGini provides an AI assistant that replies to customers on channels you connect, plus tools for orders, couriers, payments, follow-ups and analytics. Features may change as we improve the product.
2. Your account
- You must provide accurate information and keep your login secure.
- You are responsible for everything done through your account, including by team members you invite.
- You must be authorised to connect the Facebook Pages, Instagram accounts and WhatsApp numbers you add.
3. Acceptable use
You agree not to use EcomGini to:
- send spam or unsolicited messages, or break Meta’s Platform Terms, Messenger, Instagram or WhatsApp policies;
- sell illegal, counterfeit or prohibited goods or services;
- mislead customers, collect passwords, card numbers or OTPs, or harass anyone;
- attempt to access other businesses’ data or disrupt the service.
We may suspend accounts that break these rules.
4. AI replies
The assistant answers from the products, prices and instructions you provide. AI can still make mistakes. You are responsible for the information you give it and for reviewing important conversations. You can take over any chat at any time.
5. Your data
You own your business data and your customers’ data. You give us permission to process it only to provide the service, as described in our Privacy Policy. You are responsible for having a lawful basis to message your customers.
6. Fees and credit
Paid plans, AI usage costs and any credit balances are shown in your dashboard before you pay. Unless stated otherwise or required by law, payments are non-refundable. We will tell you in advance before changing prices.
7. Third-party services
EcomGini works with services such as Meta, Google, couriers and payment providers. Their availability and rules are outside our control, and their own terms apply.
8. Availability
We work hard to keep EcomGini running, but we do not guarantee uninterrupted or error-free service.
9. Limitation of liability
To the extent allowed by law, EcomGini and IT Pal Solutions are not liable for indirect or consequential losses, lost profits or lost sales. Our total liability is limited to the amount you paid us in the three months before the claim.
10. Ending the service
You can stop using EcomGini at any time and ask us to delete your data. We may end or suspend the service for breach of these Terms, with notice where reasonable.
11. Governing law
These Terms are governed by the laws of Bangladesh. Disputes will be handled by the courts of Bangladesh.
